First anonymous witness: Umeå District Court heard someone whose identity was not disclosed to the defense
The law on anonymous witnesses has been in effect since January 1, 2025. The first time it was applied in a courtroom was at Umeå District Court in 2026, in case number 764. The defense was not informed of the witness's identity. The judgment later stated that the testimony was not decisive. The review distinguishes between threats, evidentiary value, and the right to challenge.
Summary: The Act (2024:1180) on Anonymous Witnesses in Criminal Cases came into force on January 1, 2025. On June 4, 2026, an anonymous witness was heard for the first time in a Swedish courtroom, at Umeå District Court. The indictment concerned an 18-year-old and alleged incitements related to knife attacks in Hässelby. Neither the judging court nor the defense was informed of the witness's identity. The witness participated via a link, wearing sunglasses, from an undisclosed location. Defense attorney Emily Töyrä stated that it is impossible to assess reliability: a vendetta, a personal crime, or a relationship to the matter cannot be verified. On September 17, 2026, the district court delivered its verdict. According to Dagens Juridik, the court stated that the concerns raised against this evidence did not apply, primarily because the testimony did not constitute decisive evidence in any part. This is not proof that the law is harmless. It is proof that the first time it was used, it did not weigh on the case.
What happened in Umeå
SVT reported before the hearing that Umeå District Court had approved an anonymous witness. The presiding judge, Hans Sundberg, said he had not seen the decision and did not know who the person was, as the judging court should not know more than the accused. The witness was to be heard on June 4 via a link, wearing sunglasses, from an undisclosed location. Emily Töyrä, public defender, said that anonymity makes it impossible to verify if the witness has a personal interest in the outcome. She wanted to see the case in the Supreme Court, as the law had not been used before and there is no guidance on when the tool should be used and how the testimony should be evaluated.
DN wrote on June 22, 2026, that the person, who was heard under the alias NN, is the first to testify anonymously in a Swedish courtroom, and that the prosecutor indicated a significant threat if the identity is disclosed. According to reports, the possibility had been used in investigations before, but not during a main hearing. The district court announced its verdict on September 17. In the press release reported by TV4, the court noted that the case for the first time tested testimony according to the law. Dagens Juridik highlights what comes before the sentence: the court found that the concerns did not materialize, as the anonymous witness did not carry any individual convicting part.
What the law gives the defense – and what it takes away
Section 1 sets five requirements, all of which must be met. A significant risk of serious crime against the witness's or a close relative's life, health, freedom, or peace if the identity becomes known. The crime must have a minimum of two years' imprisonment in the penalty scale, or an assessed penalty value over two years. Other protective measures must be insufficient or significantly more difficult. The measure must be appropriate. And the reasons must outweigh the difficulties for the accused to prepare and conduct their defense.
The last requirement is written to preserve the contradiction. The practice in Umeå shows what remains of it. The court that examines the anonymity, according to Section 7, may hear who the witness is, if the witness is close to a party, and if there are circumstances affecting credibility. The court that judges, and the defense, do not receive this account. Sundberg described the order as intended: the court knows no more than the accused. Section 4 provides a public counsel when the prosecutor applies. The counsel monitors legal security in the anonymity case. The counsel is not the accused's defender and does not represent the accused in the question of guilt.
Section 9 allows for links, closed doors, and concealing voice or appearance. Section 11: the decision applies immediately unless the court states otherwise. An appeal is possible, and a higher court can decide that the decision should not apply in the meantime. This is the control afterward. It does not help the question posed during the hearing: why should I believe this person.
Three thresholds: threat, anonymity, evidential value
Distinguish between three thresholds.
- The threat. A significant risk of serious crime against life, health, freedom, or peace. This is the reason to conceal the name. The prosecutor assesses the threat level in the application. A different composition of the court examines it, with public counsel. The accused is not present when the identity is disclosed.
- Anonymity in the courtroom. The judging court and the defense hear the testimony without knowing who is speaking. Relationship, personal interest, and previous conflicts cannot be questioned. Töyrä's objection lies here, not in the possibility that a threat cannot exist.
- Evidential value. Umeå District Court did not attach decisive weight to the testimony. Dagens Juridik calls it a slow leak: anonymity forces the court to be cautious, and thus the witness rarely carries the case. The next prosecutor can still invoke the same tool. Caution is not a rule in the law. It is an assessment in a judgment.
An earlier investigation, led by Justice Stefan Johansson, opposed anonymous witnesses. A later investigation under Fredrik Wersäll proposed the system that became law. The Council on Legislation warned that an anonymous statement could be used as evidence without the witness being verifiable. Umeå is the first practical response, and the response is that the statement was included without being decisive. It is a narrow answer.
Neuman Juridik provides the guide on when the court may allow an anonymous witness: the five requirements, who may apply, and what the defense can do. This text pertains to what happened when the requirement was used for the first time.
What the reader should do with this
- Read Section 1, point 5 before point 1. The threat is the condition. The balance against the defense is what should prevent the threat from being sufficient on its own.
- Distinguish between the anonymity decision and the verdict. The first informs another composition of who the witness is. The second evaluates the statement without that name.
- If you are the accused and the prosecutor invokes an anonymous witness: the decision can be appealed, and a higher court can suspend it. The practical review is available at Neuman Juridik. Also see what can be requested – the identity in the anonymity case is confidential.
Frequently Asked Questions
Was it the first time the law was used?
The first time in a main hearing, on June 4, 2026, in Umeå. The law had been in effect since January 1, 2025, and according to reports, had been used in investigations before then.
Did the court know who the witness was?
The composition that examines the anonymity receives the identity. The composition that judged in Umeå did not receive it. Sundberg stated that the court should not know more than the accused.
Was the 18-year-old convicted based on the anonymous witness?
The district court wrote that the statement did not constitute decisive evidence in any part. The verdict was based on other evidence. This does not remove the defense's objection that the statement could not be verified.
Can the accused themselves request an anonymous witness?
Yeah. Section 3 grants both the prosecutor and the suspect that right. The witness cannot apply themselves.
